Official Rules and Eligibility
ELIGIBILITY:
You must be 18 years or older to purchase a raffle entry. Online one (1)
individual may be identified as the purchaser (or buyer) of the raffle
entry. All federal, state and local laws and regulations apply. Entries
may be purchased via the Internet by visiting
www.minicooperraffle.com. Tickets will be mailed to internet purchasers upon
order. Raffle tickets are non-transferable and non-refundable; all
tickets sales are final.
INTERNET PURCHASES:
This car raffle will be posted on the internet at www.minicooperraffle.com.
It is the purchaser's responsibility to provide a valid email and US
Postal mailing address and contact information in order to successfully
receive the ticket and to remove any system blocks that would prevent
the successful delivery of the email confirmation. Confirmation
information may be mailed to entrant upon request. Mcguire Memorial,
Board, or members assume no liability for lost, late, misdirected,
mutilated, illegible, undelivered entries. Entries without proper
payment received will be deemed invalid and shall be immediately
disqualified.
DRAWINGS:
Ticket prices are 1 for $25 or 5 for $100. The Grand Prize Draw Date is
Saturday, February 21, 2009. Tickets can be purchased from members and online until 5:00 pm (EST) February 21,
2009.
NOTIFICATION OF WINNERS:
Winner need not be present to win. The first winner will have their
choice of one of the two Mini Coopers. Winner will be notified
by phone and or in writing
via Registered Mail of requisite procedure to claim prize. Winner's name
will be posted at www.minicooperraffle.com and www.mcguirememorial.org
within 5 calendar days of the drawing. Winning entrant is required to
inform McGuire Memorial within seven (7) calendar days from notification
of their choice to take possession of the car, however, winners
may have up to fourteen (14) calendar days of draw date to finalize the
process (including payment of taxes, withholding, etc). Winning
entrants' name and location by city or town and photo will be printed in
selected media. If selected winning entrant is unable to be contacted or
located after a period of one (1) month from the draw date, the prize
will be donated to the McGuire Memorial. Three (3) attempts will be made
to contact the winning entrant via Registered Mail at the address
provided by the entry purchaser and via email and phone as provided.
TAXES AND IRS RULES:
Winner is responsible for any and all federal, state and local income or
excise taxes, fees, assessments and like charges associated with the
prizes. Vehicle winner will be responsible for any and all state or
local tax, license, title and registration fees associated with the
vehicle. Winner will be responsible for any or all delivery fees and/or
are responsible for retrieval of their prize. The value of your winnings
is considered taxable income. Please consult your financial advisor to
discuss any impact on your personal taxable income. The IRS has taken
the position that amounts paid for chances to participate in lotteries,
raffles, or similar programs are not gifts and therefore, the price of
entry does not qualify as a deductible charitable contribution.
WAIVER/LIMITATIONS OF LIABILITY:
Entrants, by participating (and winners accepting a prize) release the
McGuire Memorial Organization officers, partners, and agents, including
advertising and promotion agencies, from any and all liability with
respect to participation in the promotion and possession or use of the
prize(s) awarded. Entrants will not hold the McGuire Memorial
Organization responsible or liable for any or all accidents, theft or
damages resulting by their participation in this event.
RELEASE:
Entrants, by participating, agree to allow the McGuire Memorial to use
their names, photos and statements in promotional material. McGuire
Memorial will not share other personal information from entries with
other organizations.
